In this privacy notice, we seek to explain to you in the clearest way possible what information we collect, how we use it and what rights you have in relation to it. This privacy notice applies to all information collected through the app; as well as any related services, sales, marketing or events. Personal information you disclose to us In Short: We collect information that you provide to us. We collect personal information that you voluntarily provide to us when you register or express an interest in obtaining information about us or our products and services, when you participate in activities on Afrijula (such as registering, leaving comments etc) or otherwise when you contact us. The personal information that we collect depends on the context of your interactions with us, the choices you make and the products and features you use. All personal information that you provide to us must be true, complete and accurate, and you must notify us of any changes to such personal information.

2. WILL YOUR INFORMATION BE SHARED WITH ANYONE? To comply with laws and to protect your rights, we will not share any information without your consent, We may however, process or share your data that we hold based on the following legal basis: Consent: We may process your data if you have given us specific consent to use your personal information for a specific purpose.

Legitimate Interests: We may process your data when it is reasonably necessary to achieve our legitimate business interests.

Performance of a Contract: Where we have entered into a contract with you, we may process your personal information to fulfill the terms of our contract.

Legal Obligations: We may disclose your information where we are legally required to do so in order to comply with applicable law, governmental requests, a judicial proceeding, court order, or legal process, such as in response to a court order or a subpoena (including in response to public authorities to meet national security or law enforcement requirements).

3. IS YOUR INFORMATION TRANSFERRED INTERNATIONALLY? Our servers are located in The Gambia. If you are accessing our site from outside of the Gambia, please be aware that your information may be transferred to, stored, and processed by us in our facilities and by those third parties with whom we may share your personal information. We will however take all necessary measures to protect your personal information in accordance with this privacy notice and applicable law.

4. HOW LONG DO WE KEEP YOUR INFORMATION FOR? In Short: We keep your information for as long as necessary to fulfill the purposes outlined in this privacy notice unless otherwise required by law. We will only keep your personal information for as long as it is necessary for the purposes set out in this privacy notice, unless a longer retention period is required or permitted by law (such as tax, accounting or other legal requirements). When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize such information, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

5. DO WE COLLECT INFORMATION FROM MINORS? In Short: We do not knowingly collect data from or market to children under 15 years of age. We do not knowingly solicit data from or market to children under 15 years of age. By using Afrijula, you represent that you are at least 15 or that you are the parent or guardian of such a minor and consent to such minor dependent’s use of the site. If we learn that personal information from users less than 15 years of age has been collected, we will deactivate the account and take reasonable measures to promptly delete such data from our records. Account Information If you would at any time like to review or change the information in your account or terminate your account, you can: Upon your request to terminate your account, we will deactivate or delete your account and information from our active databases. However, we may retain some information in our files to prevent fraud, troubleshoot problems, assist with any investigations, enforce our Terms of Use and/or comply with applicable legal requirements. Opting out of email marketing: You can unsubscribe from our marketing email list at any time by clicking on the unsubscribe link in the emails that we send or by contacting us using the details provided below. You will then be removed from the marketing email list – however, we may still communicate with you, for example to send you service-related emails that are necessary for the administration and use of your account, to respond to service requests, or for other non-marketing purposes.

This Privacy Policy describes the data we collect, how it is used and shared and your choices regarding this data. We take this responsibility seriously and have put measures in place to protect your data at every step of its lifecycle with us. This policy describes your rights and our obligations in order to comply with the Gambia’s Information law. This policy may change from time to time, so please check this page occasionally to ensure that you are aware of and are happy with any changes. Who we are

DeliveryboyApp is under Afrijula. The legal jurisdiction of this site is The Gambia. This policy applies to any users of the Deliveryboy App’s Services anywhere in the world, including any users of Deliveryboy app, features or other services. We will not use or share your data with anyone except as described in this Privacy Policy. We use your personal data for providing and improving the Service. By using the Service, you agree to the collection and use of data in accordance with this policy. Unless otherwise defined in this Privacy Policy, terms used in this Privacy Policy have the same meanings as in our Terms and Conditions. Our Privacy and Cookie Policies are written in compliance with and subject to the laws of The Gambia only. Where this policy refers to “we”, “our” or “us” below, unless it mentions otherwise, it’s referring to the particular company that is the registered Data Controller of your personal information, i.e. in this instance DeliveryApp. A “Data Controller” is an organisation that decides why and how personal information is processed. Purpose of the data processing

We collect data from our Drivers and Customers, when they sign up to use our Services and throughout the provision of those Services. We also collect personal data from different categories of people, including; previous and prospective Drivers and Customers, other individuals and businesses who may be connected with them, people who visit our offices and other people who may interact with us as part of our operations. The purpose of collecting such data is to ensure and enhance the provision of the Services, to our Drivers and Customers.


The lawful bases for processing

As part of obtaining data in providing the Services to our Drivers and Customers, the lawful bases we rely on for processing this information are; contractual: Where we are required to process personal data in order to perform our contractual obligations; legitimate interests: the processing is necessary for our and/or your legitimate interests; consent: Where you have given us your expressed consent to process your personal data. Consent can be withdrawn at any point in accordance with your rights.


Types of personal data we obtain and the data source

We collect data from you in the following ways: This is information about you that you give to us by, for example: Using our mobile application (including but not limited to; online chat) Corresponding with us by phone, email or otherwise. This data is provided by you voluntarily. This includes information provided at the time of registering to use our App, subscribing to the Services we provide through our channels, requesting information, material or further services, managing your personal details (including accessing documentation and engaging in correspondence with us by phone, email or otherwise). If you complete any surveys that we request you complete for marketing and/or research purposes, we will collect information in such circumstances as well. The Deliveryboy App collects personal data from both Drivers and Customers when they sign up to use our Services and throughout the provision of those Services. We also collect personal data from different categories of people, including; previous and prospective Drivers and Customers, other individuals and businesses who may be connected with them, people who visit our offices and other people who may interact with us. Any personal data stored within the platform through which our Services are provided must not be copied by any user of our Services in any format and used outside of the Services. The information you give us will typically include your name, address, email address and phone number(s), your specific enquiry details and may include records of any correspondence and responses to referrals and/or marketing campaigns. Further details of the data captured from Drivers and Customers are outlined below. Driver personal data collected We obtain the following personal data from Drivers (which includes but is not limited to); Personal Driver information including; full name, email address, telephone number; Drivers may produce additional documentation relating to specific Customer requirements In order to receive remuneration, Drivers are paid by their own companies. This process is not managed by Deliveryboy App. Driver data provided by Drivers to such their company is not shared with Deliveryboy App; We recommend you also review the Privacy Policy of any third party payment processing affiliate we may refer you to. Where Drivers are a registered business, they may also provide their VAT and registered Companies number.


We may use third parties to complete digital identity verification checks in relation to users of our services. Identity checks are critical in preventing fraud and ensuring compliance with anti-money laundering regulations. This process will involve data being shared relating to the person(s) being verified, this includes but is not limited to; name, address, date of birth, vehicle registration, passport and driver licence number. Customer and Merchant personal data collected We obtain the following personal data from Merchant and Customers (individuals and businesses), which includes but is not limited to; Customer information including; full name, address, telephone number, company name (optional), email address; Pick-up details for each Job Request, including; sender name, contact telephone number, pick-up address, pick-up date and time, duration of hire (if applicable), whether they need assistance with loading/unloading item; Drop-off details for each Job Request, including; recipient name, contact telephone number, drop-off address, drop-off date and time; Drop-off items including; package size, weight and quantity and whether they need help with loading/unloading items, cost of goods; We shall presume that you have obtained the necessary consent from any third party who may be referred to within any Job Request. Usage and other data. Merchant, Customer and Driver personal data will be shared between the parties arranging Services using the platform in order for the Services to be facilitated. In the event of a complaint from a Merchant or Customer, Drivers grant us permission to share their names and company details, where required, to the Merchant or Customer. We may also process information about Merchant’ businessl, their relationship with Deliveryboy App, the goods or services they/their company provide and/or require. We may give you the opportunity to tell your friends about features or offers about our Services. We may ask users of our Services to complete reviews, surveys and opinion polls, to provide feedback on services, activities, attitudes and interests. These surveys help us understand the needs of our Drivers, Merchants and Customers and to improve our Services. We may then publicise any such reviews, surveys and opinion polls. Should you complete such a review and not wish for your review to be used and/or saved indefinitely, then you should notify us immediately by email, which is noted at the foot of this document. Marketing We may use your personal data to contact you with email, whatsapp or SMS newsletters, marketing or promotional materials and other information that may be of interest to you. Unless you opt out of receiving any, or all, of these communications from us by emailing us using the information noted at the foot of this document, which you can do so at any time. If you do not wish to receive such communications, please let us know in writing by sending an email to support@afrijula.gm Service Providers We may employ third party companies and individuals to facilitate our Services, to perform related services or to assist us in analysing how our Services are used. These third parties may have access to your personal data only to perform these tasks on our behalf as a data processor and are obligated not to disclose or use it for any other purpose. Such third parties may include, but are not limited to; Insist Global. We may also partner with other third party platforms to facilitate our Services. This will involve personal data being shared between the parties in order for the Services to be provided. Parties have access to your personal data only to perform these tasks on our behalf as a data processor and are obligated not to disclose or use it for any other purpose. For example; Afrijula. How we collect or obtain your personal data We may obtain personal data from you directly, from our drivers, merchant and customers, from people and organisations involved in matters we act for, from public sources and from others, such as other Drivers and Customers who may refer you to us, regulators, suppliers and professional bodies. The way we receive information from you varies, which includes, but is not limited to; filling in forms, by corresponding with us by phone, e-mail or otherwise. It includes information you provide when you register to use our site, subscribe to our Services and when you report a problem with our site. The information you give us may include your name, address, e-mail address and phone number and company financial Information (if applicable) we collect about you. Where you provide us with information directly, it is your responsibility to ensure that all such information is materially complete and not misleading. You may also provide us with personal data about other people. Please ensure you provide them with a copy of this policy, where appropriate to do so. If any information changes, please let us know so that we can keep it updated on our systems. Information collected by automated means We may use cookies, web beacons/pixel tags, log files and other technologies to collect certain information about users of our Services, use of our online services and interactions with our emails and online advertisements. For example, through these means, we may collect your GPS location, browser type and operating system, emails we send that you open.


How long do we store data for?

We retain data for as long as is deemed necessary, in accordance with your rights, depending on the legal basis we rely upon.
